The following rules and regulations constitute the rules of the online store (hereinafter referred to as the “Rules”), operated at www.lenagorzyckajewels.com (hereinafter referred to as the “Store”). Jadwiga Gorzycka Lena Gorzycka Jewels, referred to in these Regulations as “Seller”, has the exclusive right to operate the Store.

All products offered in the Store are new, free of physical and legal defects and have been made.

Photos and other forms of visualization and presentation of jewelry presented on the pages of the Store do not reflect its actual size and are for informational purposes only. In addition, the products offered in the Store are handmade, so each such product is
unique and may be minimally different from other copies of the same merchandise

We would also like to inform you that the appearance of the goods is affected by the size and parameter setting of the customer’s monitor, which may cause differences especially in the color reflection of the product.

All photos and descriptions presented in the Store are the exclusive property of the Seller or the Seller has the relevant rights to them and are protected by copyright.
II. Account registration and ordering

The customer can place orders in the Store 24 hours a day, all days of the year, while their fulfillment takes place on working days from Monday to Friday, excluding holidays and Christmas Eve and New Year’s Eve. Acceptance for fulfillment of an order placed on Saturdays, Sundays and holidays, as well as Christmas Eve and New Year’s Eve is made on the next working day.

Placing orders for goods offered in the Store is possible after registration (shopping by registration) or without registration (shopping without registration). Both ways of placing orders are described in the following sections of the terms and conditions.

The condition for registering an account in the Store as well as making a purchase without registration is reading and accepting the Rules of the Store and agreeing to the processing of personal data by the Seller for the purpose of providing electronic services. To register, select the “Registration” tab on the website www.lenagorzyckajewels.com or when placing an order, select the option “I do not have an account, I want to register.”, then provide your e-mail and password and fill out the “Contact details” form, and finally click the “I create an account” option. It is not mandatory to provide date of birth and gender in the form to be filled out. It is also possible to provide a different shipping address.

The seller does not issue VAT invoices.

As a result of a properly completed registration, the customer receives access to the account created for him, which he can use within the Store.

When making purchases through registration, the customer places an order after logging into the Store, by adding the goods presented in the Store to the shopping cart. The customer can also log in to his account after adding goods to the shopping cart in the 2nd stage of ordering after checking the option “I have an account in the store www.lenagorzyckajewels.com”. The customer then has the opportunity to select the chosen method of payment and delivery, as well as provide any comments on the order being placed.

A customer interested in making purchases without registration places an order by adding the goods presented in the Store to the shopping cart, then selects the option “I want to make a purchase without registration”, further selects whether he wants to receive a receipt or a VAT invoice, and then provides the data necessary to complete the order, such as: name and surname, address, telephone, e-mail address, delivery address if different from the primary address, and the data necessary for a possible VAT invoice, if the customer has selected the option to issue an invoice. It is not mandatory to provide date of birth and gender. After providing these details, the customer has the opportunity to choose the method of payment and delivery, and to enter any comments on the order.

Both for purchases through registration and without registration, after the customer enters all the necessary data, a summary of the placed order will be displayed, including: description of the subject of the order, unit and total price of the ordered goods, the type of delivery chosen by the customer along with its cost and the chosen method of payment, customer data and address.

The ordering procedure ends, both for purchases through registration and purchases without registration, when the customer selects the “I place an order and pay” option. Performing this action means placing an order and concluding an agreement with the Seller for the sale of goods covered by the order.

A message is sent to the e-mail address indicated by the customer when placing the order, confirming the conclusion of the sales contract with the Seller and confirming acceptance of the order for processing, and in the next sequence current information on the progress of the order will also be sent to the customer by e-mail.

The contract of sale can only be concluded by a person of full legal age with full legal capacity.
III. Prices and payment methods

All prices are in Polish zloty and include VAT.

The prices listed next to the products do not include shipping costs.

Discounts that are given to customers are not cumulative. Discounts resulting from discount codes are calculated on the list prices of the products, that is, the prices before the promotion. If the promotional price of the product entered by the Store is lower than the price that would result from the use of the discount code that the customer would like to use, then the discount code will not be charged and the customer will be able to purchase the product at the lower price, which is the promotional one. Example: the list price of the product is 100 PLN and the promotional price is 80 PLN, and the customer has a discount code entitling him to a discount of 15%, then the discount resulting from the discount code will not be calculated, because the promotional price ie. 80 PLN is lower than the price that would result from using the discount code, i.e. 85 zł. If the customer’s order includes several products, some of which are only discounted, it is possible that the discount resulting from the discount code used by the customer will be calculated only for part of the products, i.e. products not covered by any other promotion or products for which the promotional price will be higher than the price resulting from the customer’s use of the discount code according to the situation described above. Only one discount code can be used per order.

The price listed next to each product is binding at the time the customer places the order.

Information on the total value of the order, including shipping costs, is displayed after the customer selects the form of payment and delivery of the order.

The Seller reserves the right to change prices of goods on offer, introduce new goods to the offer of the Store, carry out and cancel promotional actions on the pages of the Store, or make changes to them. The above does not affect orders placed before the effective date of the price change, terms of promotional actions or sales, which will be carried out under the existing terms.

When making a purchase, the customer may choose the following forms of payment for the order placed: payment on delivery – during personal collection (at the address: 01-793, Warsaw, 11A/248 Rydygiera St.), or prepayment – payment by ordinary transfer, and postal or bank payment to the Seller’s bank account, as well as electronic payment by credit card, online transfer or by PayPal through the service Dotpay.
IV. Delivery methods and costs

The available and current delivery methods and costs for products ordered from the Store are always shown on the Store’s website. Delivery methods and costs are also provided for the information and choice of customers in the “Your cart” tab before placing an order in the Store.

The Seller reserves the right to change the cost of shipments and to change the carriers it uses to deliver to customers orders placed in the Store in the event of changes in shipping prices by the carriers the Seller uses. Such a change does not apply to orders placed before the change.

Each completed order is accompanied by a document of purchase in the form of a card with a logo on it, on which the order number and the amount, paid for the order, excluding shipping costs. According to Art. 111, para. 1 of the VAT Law The seller is not required to issue a fiscal document of sale.

Order fulfillment should be understood as the time of manual execution of the ordered goods, to which you must add the number of days of delivery by the selected carrier.

The execution of the order is carried out after it has been paid for or after the customer has chosen the option of personal collection with payment on delivery.

If the customer chooses to pay in advance for the order placed, payment should be made within 14 days from the date of placing the order. If payment is not made by this date in accordance with Art. 492 of the Civil Code of April 23, 1964. (Journal of Laws No. 16, item 93, as amended), the Seller may withdraw from the contract, and thus the transaction is considered obsolete and will be canceled.

Preparation of the order for shipment or for personal pick-up by the customer is from 2 to 4 working days counting from the moment of sending to the customer’s e-mail address indicated by the customer when placing the order information about receiving payment for the ordered goods or from the moment of receiving information from the customer about choosing the option of personal pick-up with payment on delivery. In special cases, it may take up to 30 (thirty) days to prepare an order. In this case, the customer will be informed at the e-mail address provided in the order about the extension of his order.
VII. Complaints (under warranty)

The Seller shall be liable to the customer who is a consumer under the warranty for physical defects (non-conformity of the goods with the contract) and legal defects (such as ownership or encumbrance of the thing by a third party’s right) of the products purchased in the Store. This applies to defects that existed at the time of the passage of danger to the customer or are due to a cause inherent in the sold product at the same time. The scope of the warranty is defined by the Civil Code of April 23, 1964. (Journal of Laws No. 16, item 93, as amended) and other generally applicable laws, including the Law of May 30, 2014. The customer is entitled to the following requests: repair of goods, replacement of goods with defect-free goods, price reduction, withdrawal from the contract.

The seller is liable under the warranty if the physical defect is discovered before 14 days from the release of the goods to the customer. The claim for free repair of goods is barred by the statute of limitations of one year. Within this period (14 days from receipt of the goods), the customer may withdraw from the contract of sale or make a statement of price reduction due to a defect in the goods. After one year, the seller will repair the goods for a nominal amount. The seller in this case does not cover shipping costs both ways. They are covered by the Buyer.

A complaint can be submitted in any form. We prefer to submit complaints by email at: elenagorzycka@gmail.com. In order to process the complaint efficiently, we recommend including the following data in the complaint: name, address, e-mail address, telephone number, the subject of the complaint and the order number, indicating the customer’s request, any circumstances justifying the complaint, the date on which the defect was found, and if possible photos of the defect.

If the data or information provided in the complaint needs to be supplemented, the Seller will ask the complainant to supplement it to the extent indicated before considering the complaint.

If it is necessary to process the complaint, the customer will be asked to return the advertised product to the Seller at the address:

The seller will promptly, but no later than within 14 (fourteen) days, respond to the customer’s complaint and notify the customer on how to proceed.

It is possible to exchange goods purchased from the Store.

Only goods with no signs of use can be exchanged.

Exchange is possible only for goods in the same category and at the same price. If you want to exchange for goods from another category and / or at a different price, use the withdrawal option described in the next section: “Right of withdrawal, and then place a new order in the Store”.

The cost of delivering the replacement goods to the Seller shall be borne by the customer, while the cost of delivering the replacement goods to the customer within the country shall be borne by the Seller. If the shipment is to be sent abroad, the Buyer should cover the cost of such shipment according to the With the current delivery price list.

Replacement goods will be shipped within 7 business days of receipt of the goods to be exchanged, along with the necessary information listed in Section 6.

A customer who is a consumer has the right, without giving any reason, to withdraw from the contract of sale within 14 days from the date of delivery of the goods into the possession of the customer or a third party other than a carrier designated by the customer, in accordance with the provisions of the Act of May 30, 2014. If the customer made a statement of withdrawal from the sales contract before the Seller accepted his offer, the offer ceases to be binding.

The right of withdrawal from a contract concluded at a distance does not apply to consumers in cases of services with characteristics specified by the consumer in the order placed by him or closely related to his person. This means that the Seller is not obliged to accept the return of goods made to the customer’s special order or modified at the customer’s request. This also applies to jewelry with engraving made according to customer guidelines.

In the event of withdrawal from the contract, the contract is considered not concluded.

If the consumer withdraws from the sales contract under the terms described above, he is obliged to return the products covered by the contract. The return should be made no later than 14 days from the date of withdrawal from the contract to the address given in point 2.

The consumer is liable for any diminution in the value of the product resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the product. In this case, the returned amount may be reduced by the amount resulting from the reduction in the value of the returned item. Returned jewelry must not have any odors. The smell of perfume on jewelry is considered to be the use of jewelry, and due to the impossibility of removing it, such a return will not be accepted.

The customer bears the direct costs of returning the goods, i.e. return shipping fee. This is the only cost associated with the return of the item that the customer bears. It is also possible for the customer to personally deliver the returned goods to the Seller’s premises by appointment.

The seller is obliged to immediately, no later than 14 days from the date of receipt of the customer’s statement of withdrawal from the contract of sale, return to him all payments made by him, including the cost of delivery, unless the customer has not incurred such a cost.

If the Customer exercising the right of withdrawal has chosen a method of delivery of the goods other than the cheapest ordinary method of delivery offered by the Seller, the Seller shall not be obliged to reimburse the Customer for the additional costs incurred by the Customer.

The refund of the amount paid by the customer, taking into account the proviso in paragraph 11, will be made, at the customer’s choice, by bank transfer to the designated bank account number or by postal order within 14 days from the date of withdrawal from the contract. Both ways of returning the amount paid by the customer do not incur any additional costs for him.

The Administrator shall apply appropriate technical and organizational measures to ensure the protection of the processed data, and in particular shall protect the data against unauthorized access, processing in violation of the law, and alteration, loss, damage or destruction. Only persons authorized by the Administrator are allowed to process your data within the Administrator’s organization.

The vendor does not charge any fees for their provision.

The minimum technical requirements for using the Store are a web browser with at least: Internet Explorer version 9, Chrome version 16, FireFox version 10, Opera version 11, Safari version 5 or later with Javascript enabled and accepting cookies, and an Internet connection.

The Contact Form service involves sending a message to the Seller using a form on the Store’s Website. Cancellation of this service is possible at any time and consists in ceasing to send inquiries to the Seller.

A customer account in the Store facilitates the placement of orders, allows you to view orders placed and edit the data provided by the customer during account registration.

The process of creating a customer account in the Store is described in the Store’s terms and conditions in Section 4 of Chapter II. Account registration and ordering.

You may also cancel your customer account with the Store at any time. For this purpose, it is sufficient to submit to the Seller an appropriate statement of intent using any means of remote communication, allowing the Seller to become acquainted with the Customer’s statement of intent. Your account will then be deleted from the system immediately, but no later than within 14 days. Nevertheless, you will be able to create your account again in the future.

The Seller is entitled to block access to the customer’s account and other electronically provided services, in the case of the Customer acting to the detriment of the Seller or other customers, violation of the law or the provisions of the Terms and Conditions by the Customer, as well as when blocking access to the customer’s account and other electronically provided services is justified by security reasons, in particular: breaking the security of the Store’s Website by the Customer or other hacking activities. The blocking of access to the Customer’s account and free services for the listed reasons lasts for the period of time necessary to resolve the issue forming the basis for the blocking of access to the Customer’s account and free services. The Seller shall notify the Client about blocking access to the Client’s Account and free services by e-mail to the address provided by the Client in the registration form.

Complaints about services provided electronically should be addressed to the Seller according to the rules described in the section of the Regulations “Complaints (under warranty)”.

In the event of a change in the rules and regulations, orders placed before the date of introduction of changes to the rules and regulations will be fulfilled on the existing terms.

If a dispute arises under the concluded Sales Agreement, the parties will seek to resolve the matter amicably. The governing law for the resolution of any disputes arising under these Terms and Conditions shall be Polish law.

A buyer who is a consumer can also use an out-of-court procedure for handling complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Warsaw.
